Introduction

Welcome to WeShare. By accessing or using our mobile application (‘App’), website, services and applications (collectively, ‘Services’), you agree to be bound by these Terms of Service (‘Terms’). These Terms affect your legal rights and obligations, so please read them carefully.

1. Acceptance of the Terms

By using the WeShare Services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree with any of the terms and conditions contained in these Terms, you must not access or use the WeShare Services.

2. Changes to the Terms

WeShare reserves the right, at its sole discretion, to modify or replace these Terms at any time. If the changes constitute a material modification of the Terms, WeShare will notify you by posting a notice on the App.

3. Access to and Use of the Services

  • Eligibility: You must be at least 18 years old to access or use our Services.

  • License to Use: WeShare grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial use.

  • Restrictions on Use: You agree not to use the Services in any manner that could damage, disable, overburden, or impair the Services, or interfere with any other party's use and enjoyment of the Services.

4. Content

Content' means any information, text, graphics, or material uploaded, downloaded or appearing on the Services. You represent that you own all rights to your Content or have all necessary permissions to post it on the Services.

5. Privacy

Your privacy is important to WeShare. WeShare's Privacy Policy explains how we collect, use and share your personal information. By using the Services, you also agree to the terms of our Privacy Policy.

6. Termination

WeShare may terminate or suspend your access to the Services immediately, without notice or liability, for any reason, including, without limitation, if you breach the Terms.

7. Disclaimer of Liability in Peer-to-Peer Rentals

WeShare acts as a technology platform to facilitate the rental of items between individuals. While WeShare is not a direct contractual party between users, it does act as an intermediary by securely managing payments and deposits.  

Responsibility for the rented item and the terms of the rental lies solely with the owner and the renter.  

WeShare does not guarantee the legality, safety, or suitability of rented items and is not responsible for any personal, material, or third-party damage resulting from their use.  

In case of disputes, WeShare may act as a mediator and, if deemed necessary, use the deposit to help resolve the issue.

8. Disclaimer of Warranties and Limitation of Liability

The Services are provided "as is". WeShare makes no warranties, express or implied.  

WeShare shall not be held liable for any damages arising from the use of the Services, nor for the quality, legality, safety, or functionality of items rented through the platform.  

Users are solely responsible for verifying this information with each other.

9. Partner Promotions

From time to time, WeShare may offer special promotions in collaboration with partners, including cooperatives or other organizations. These promotions may include benefits such as discounts, which are only available to users who register using specific referral links or codes. These offers are valid only for new users, are non-transferable, and may be subject to change or discontinuation at any time without prior notice. We reserve the right to revoke promotional benefits in cases of abuse, misuse, or violation of our Terms.

10. End User Agreement (EULA)

  • License to Use: WeShare grants you a limited, non-exclusive, non-transferable, revocable license to use the WeShare Application solely for your personal, non-commercial use.

  • Restrictions on Use: You may not decompile, reverse engineer, disassemble, attempt to derive the source code or decrypt the App, modify, adapt, enhance, translate or create derivative works of the App, or use the App for any commercial purpose without WeShare's prior written consent.

  • Intellectual Property: All intellectual property rights in the App and its content are owned by WeShare.

  • Limitation of Liability: In no event shall WeShare be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the App, even if WeShare has been advised of the possibility of such damages.

  • Warranties and Disclaimers: The App is provided ‘as is’ and ‘as available’, without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose and non-infringement.

  • Termination: This license shall be effective until terminated. Your rights under this license will terminate automatically without notice from WeShare if you fail to comply with any term of this agreement.

  • Governing Law and Dispute Resolution: This agreement shall be governed by and construed in accordance with the laws of Spain. Any dispute arising in connection with this agreement shall be resolved in the courts of Spain.

11. Prohibited Items

It is strictly forbidden to publish, lend, rent, or exchange through WeShare any item that is illegal under applicable law, including but not limited to:

  • Firearms  

  • Drugs or controlled substances  

  • Pornography  

  • Stolen or counterfeit goods  

  • Any other item that infringes on third-party rights

 

WeShare reserves the right to remove such content and suspend associated accounts. You agree that you are solely responsible for ensuring your items comply with the law.

12. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the country or state where WeShare has its principal place of business, without regard to its conflict of law provisions.
